Jorge Germán Luis Maldonado Velásquez died that day at 4:00 hours, at the Hospital Sótero del Río, due to pulmonary trauma and trauma to the left subclavian artery and vein caused by a bullet, as recorded in the Medical Death Certificate from the Legal Medical Institute.
According to the records in the judicial proceedings, at approximately 2:00 hours that day, Jorge Maldonado was on a public street, inside the Nuevo Amanecer neighborhood. Upon noticing that three carabineros were beating a person they had detained, he attempted to approach the police officers, along with a friend.
In judicial statements, eyewitnesses indicated that the officers drew their service weapons and both young men began to run. At that moment, Jorge Maldonado was struck in the back by a projectile fired by one of the carabineros.
He died at a hospital center to which he had been taken.
To investigate his death, proceedings were initiated in the Fourth Military Prosecutor's Office of Santiago, which were temporarily dismissed because the Military Judge determined that, despite the commission of the crime of homicide being proven, there was insufficient evidence to charge a specific person as the perpetrator.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council declared Jorge Germán Luis Maldonado Velásquez a victim of human rights violations by State agents who made improper use of force.
