On September 4, 1985, ten people died during the demonstrations related to the Fourteenth National Day of Protest:
Jorge Enrique PARDO ABURTO, 15 years old, a vocational technical student, died from a gunshot wound.
At noon on the 4th, some youths were protesting at barricades near an Open Center guarded by military personnel. When a Carabineros bus arrived at the scene, the youths threw stones at it and then fled in the opposite direction of the Open Center.
At that moment, a soldier fired at the fleeing youths, killing Jorge Enrique Pardo. The facts are established by several testimonies that the Commission considered credible.
Weighing the gathered evidence, the Commission estimates that, notwithstanding the need to legitimately defend the Open Center and public order, the use of force was in fact excessive in this case, given that the youths were fleeing the scene when shots were fired at them and no longer posed any danger.
In this sense, the Commission is convinced that Jorge Enrique Pardo was a victim of excessive use of force by State agents, who thereby violated his right to life.
