On September 19, 1973, the following individuals were killed by Carabineros in Tocopilla:

Ernesto Manuel MORENO DIAZ, 18 years old, high school student, member of the Socialist Party.

Iván Florencio MORAN ARAYA, 21 years old, employee, member of the Socialist Party.

Both young men were detained by Carabineros in Tocopilla at approximately 8:00 p.m. on September 18, 1973, to be taken to the local police station, according to those who arrested them. The following day, September 19, at 12:45 a.m., their bodies were delivered to the city hospital morgue, with the explanation given for their deaths being that both had attempted to escape.

The death certificates indicate the place of death as: "Tocopilla, public thoroughfare Avda. Costanera s/n." The condition of the bodies showed that the young men had been killed by beatings and gunshot wounds. No official or public version of the events was provided.

The Commission formed the conviction that the deaths of both detainees constituted an execution outside of all legality, for which State agents were responsible, based on the following considerations:

– The existence of testimonies indicating that both detainees, after their apprehension, were handcuffed and tied up, which makes it practically impossible that they could have attempted to flee from their captors; – Likewise, the detainees were unarmed and at the mercy of their captors, who were in turn armed police officers trained to control detainees, which adds even greater implausibility to the attempted escape; – There are reliable testimonies regarding the presence of the detainees inside the police station, and there is no explanation or reason for them to have been taken out of there later, only a few hours after their apprehension.
