The visiting minister of the Temuco Court of Appeals, Álvaro Mesa Latorre, subjected former Carabineros officer Pedro Fernando Iturra Carvajal to indictment and pretrial detention as the perpetrator of the crime of qualified homicide against Anastasio Molina Zambrano, committed in the commune of Carahue on October 11, 1973.
According to the case records, the following facts have been determined: «Anastasio Molina Zambrano, an agricultural worker and militant of the Partido Socialista, residing at the Fundo "La Esperanza" in the town of Nehuentúe, commune of Puerto Saavedra, presented himself at the Juzgado de Letras of Carahue in the first days of October 1973, after having been notified by the Carabineros of Carahue that he was required to appear there.
The Court ordered the detention of Molina Zambrano for being accused of an alleged theft of animals, and he was transferred to the Tenencia of Carahue, which at that time functioned as an annex to the prison.
In the morning hours, Molina Zambrano, for unknown reasons, fled from inside the police unit where he was being held, running in the direction of the Damas River. A Carabinero, who was on exterior guard duty, went in pursuit, firing shots into the air with the object of persuading the fugitive to stop.» The ruling adds «that at a certain moment in the pursuit, Sergeant Alisandro Millar Suazo, belonging to the staff of the Subcomisaría de Carabineros of Carahue, joined in; he was off-duty that day but had left his home alarmed by the shots.
Together with the other Carabinero, they went down a slope leading to the Damas River, pursuing Anastasio Molina Zambrano... Sergeant Millar fired at Molina Zambrano's body, but he did not fall immediately, so he used his service weapon again, after which Molina Zambrano collapsed next to the bank of the Damas.
At that location, the aforementioned Carabineros waited for the arrival of other personnel and subsequently took the lifeless body of Anastasio Molina Zambrano to the morgue of the Carahue hospital.»

Sergeant (ret.) is sentenced to 6 years in prison for homicide in Carahue during the dictatorship
The visiting minister for extraordinary cases of human rights violations of the Temuco Court of Appeals, Álvaro Mesa Latorre, sentenced retired Second Sergeant of the Carabineros Pedro Fernando Iturra Carvajal to six years in prison as the perpetrator of the crime of homicide against Anastasio Molina Zambrano, committed in the commune of Carahue on October 11, 1973.
Minister Mesa also sentenced the uniformed police non-commissioned officer to absolute perpetual disqualification from public offices and political rights, and absolute disqualification for professional titles for the duration of the sentence, not granting the convicted man any benefit contemplated under Law No. 18.216.
In civil matters, the magistrate ordered the State Treasury to pay the sum of $400,000,000 (four hundred million pesos) as compensation for damages, for moral injury resulting from the crime of simple homicide, in amounts distributed in the sentence.
