Humberto Fernando Fernández Trujillo died that day at 1:30 a.m. in the Nueva La Bandera neighborhood, due to a thoracic gunshot wound with no exit wound, resulting in acute anemia, as recorded in his Death Certificate. The Autopsy Report adds that the body presented two other gunshot wounds in the abdomen and the left forearm.

According to information gathered by this Corporation, on the day indicated and in the early hours of the morning, the home of Humberto Fernández, located in the Nueva La Bandera neighborhood in the commune of La Granja, was raided by members of the O.S.7 of Carabineros.

According to statements from family members, the uniformed officers entered the house by breaking down the front door and shining flashlights into the faces of the residents. Fernández Trujillo got out of bed and, without any provocation on his part, was struck by a bullet in the chest, falling to the floor.

Under those circumstances, one of the police officers shot him several times. He died instantly.

A case was opened at the Second Military Prosecutor's Office of Santiago to investigate his death. That case was definitively dismissed by the Court Martial, by virtue of Decree Law 2.191 of 1978, regarding amnesty.

Considering the evidence gathered and the investigation carried out by this Corporation, the Superior Council declared Humberto Fernando Fernández Trujillo a victim of human rights violations by State agents who made irrational use of force.
