On December 23, 1973, two individuals were executed by carabineros in the Molco sector, Choshuenco, at the Complejo Panguipulli:
Hugo Ribol VASQUEZ MARTINEZ, 21 years old, university student, militant of the Movimiento de Izquierda Revolucionaria (MIR);
Mario Edmundo SUPERBY JELDRES, 23 years old.
Both had been hiding in the mountains in the Choshuenco sector, from where they would sporadically descend to the town to obtain food. According to press reports from the time, "two extremists were killed during the course of an operation carried out at 11:45 PM by officials from Choshuenco at the location known as Molco.
As Carabineros were patrolling the sector, they were attacked with gunfire by the extremists, immediately repelling the attack. During the shootout, Hugo Ribol Vásquez Martínez, 21 years old, was killed by impacts to the thorax; he was carrying a Winchester repeating rifle.
He was with another subject nicknamed 'El Braulio,' who was wounded in the legs and died on the way while being transported to the Panguipulli Hospital."
The Commission reached the conviction that the reported confrontation did not occur, and that the deaths of both victims constituted a violation of their fundamental rights for which State agents were responsible, as they used unnecessary or excessive force and fired upon them. This conviction is based on the following considerations:
– Direct witnesses to the events, deemed credible by the Commission, indicate that it was an ambush prepared by police forces who knew they would arrive at the location in search of food and executed them;
– No police official was injured in the incident, despite the official version indicating that it had been an armed attack;
– Finally, even if such an attack had occurred, the patrol could well have arrested them, as they had the means to do so, instead of firing upon them.
