Hernán Rodolfo BARRALES RIVERA, 24 years of age, worked for the Occupational Program for Heads of Households (POJH). On the morning of the 4th, he was near debris obstructing traffic at the intersection of Calle 30 de Octubre and Avenida La Feria (Santiago) when he was struck by a bullet in the back.
He died as a result of a thoracic gunshot wound. Multiple testimonies lead to the conviction that the shots were fired by carabineros from a distance. The ordinary court declared itself incompetent, with jurisdiction falling to the Military Justice system, which stated: "the aforementioned crime involved the participation of Carabineros de Chile officers in the line of duty, without it being possible to specify their identities."
Based on the evidence presented, the Commission has formed the conviction that Hernán Rodolfo Barrales was a victim of a human rights violation committed by State agents who used excessive force.
