Héctor Avelino Orellana Rojas died that day at 3:00 hours, from a gunshot wound, as stated in his Death Certificate.
According to statements from eyewitnesses, in the early hours of that day, Héctor Orellana was returning from a party with three friends in the city of Antofagasta. When they were one block away from the Second Precinct of Carabineros, they were intercepted by officers of the Carabineros Civil Commission, who were conducting a patrol.
Without provocation and without any warning, they fired at them from behind, striking Orellana Rojas in the back of the head.
Following these events, a case was opened in the First Military Court of Antofagasta. The perpetrator of the shots was sentenced to three years in prison as the author of the crime of unnecessary violence causing the death of the victim. However, he was acquitted in the second instance.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council declared Héctor Avelino Orellana Rojas a victim of human rights violations committed by State agents who made irrational use of force.
