Case File 42.350-2011: Case of Pedro Abraham Morales Retamal and others

A). Gabriel Jesús González Cadegan, previously identified, is sentenced to a single penalty of ten years and one day of major imprisonment in its medium degree, to absolute perpetual disqualification from public offices and political rights, to absolute disqualification from professional titles for the duration of the sentence, and to the payment of court costs, as the perpetrator of the following crimes: 1.- Qualified homicide of Pedro Abraham Morales Retamal, perpetrated between September 12 and 13, 1973, at the Fundo San Juan de Peteroa, Sagrada Familia, within the jurisdictional territory of Molina, as provided for and sanctioned under Article 391 No. 1 of the Penal Code. 2.- Qualified homicide of Luis Orlando Zapata Banda, perpetrated on September 25, 1973, at the Fundo El Paraguay in Molina, as provided for and sanctioned under Article 391 No. 1 of the Penal Code. Due to the failure to meet the requirements set forth in Law 18.216, especially given the severity of the sentence imposed, the accused González Cadegan is not granted any of the benefits contemplated therein (under its former wording), nor is his substitution granted (under the wording following the amendment by Law 20.603). Consequently, it is not necessary to analyze the report on supervised release on page 948 (Case File No. 42.350-2011 Molina) and on page 1661 (Case File No. 42.352-2011 Molina).
