Case summary
Germán Gustavo Castro Rojas, a 33-year-old accountant and former Intendant of Talca, was executed on September 27, 1973, by State agents at the Talca Regiment. Although the official version alleged the existence of a War Council, the Truth Commission concluded that it was an extrajudicial execution carried out outside of any legal process and without the right to a defense.

Then, on September 27, 1973, the former Intendant Germán CASTRO ROJAS, 33 years old, an accountant by profession and a member of the Partido Socialista, was executed.
The official version, provided to the press, stated that: "The resolution was adopted by the Consejo de Guerra and sanctioned by the Military Judge...", and the sentence was allegedly carried out in the early hours of September 27, when Germán Castro faced the firing squad.
The abundant and consistent information received by this Commission leads it to the conviction that the aforementioned Consejo de Guerra did not take place. At the time of the execution of the former Intendant Mr.
Castro, no sentence existed, and the decision had been made outside of any judicial procedure. Indeed, multiple qualified testimonies agree that on September 27, around 9:00 PM, a deliberation of four officers took place at the Regimiento de Talca in which the execution of the Intendant was ordered.
However, as indicated in the official version, Castro had been executed in the early hours of that day. This meeting could not be considered the constitution of a Tribunal, not even in wartime, nor could the deliberations be considered a legally processed trial in which it would have been necessary, among other things, to guarantee the defendant's right to a defense.
Previously, a brief investigation had been carried out by Carabineros which the assembled officers had reviewed, but which in no way corresponds to the inquiry proper to a Tribunal.
This Commission can affirm that there was never even a conviction on the part of the four people gathered that the author of the shots that caused the death of Carabineros Corporal Orlando Espinoza was the executed Intendant Castro.
Therefore, as no Consejo de Guerra was held, the Commission has formed the conviction that Germán Castro died executed outside of any legal process and is a victim of a human rights violation.
