Luis Guillermo Díaz Salinas and Genaro Fernando Martínez Herrera died that day at 1:00 hours, on a public thoroughfare, due to thoracic and abdominal gunshot wounds, as recorded in the respective Medical Death Certificates from the Legal Medical Institute. The Autopsy Protocols indicate that the bodies presented six and five bullet impacts with exit wounds, respectively.
Family members and eyewitnesses stated that both were detained by carabineros at the home of Luis Díaz, in the Juanita Aguirre neighborhood in the Conchalí commune, during the curfew, due to a report of causing a public disturbance in the neighborhood. On that occasion, two other people were also detained.
The four were taken near the location, where a police bus was stationed. After checking their records, they released the latter two individuals and placed Luis Díaz and Genaro Martínez on the bus, taking them to an unknown destination.
Days later, the families found their bodies at the Legal Medical Institute.
Considering the evidence gathered and the investigation carried out by this Corporation, the Superior Council reached the conviction that Luis Guillermo Díaz Salinas and Genaro Fernando Martínez Herrera were executed by State agents while being held in detention, outside of any legal process. Consequently, it declared them victims of human rights violations.
