In relation to the aforementioned execution, Frank Randall TERUGGI BOMBATCH, a 24-year-old American resident of Chile and student at the Universidad de Chile, was killed on September 22, 1973. He also participated, along with Charles Horman and other Americans, in the press group Fuente de Investigación Norteamericana (FIN).
The victim was detained in his apartment in the commune of Ñuñoa, along with another American, on September 20 at approximately 9:00 p.m. by members of the Carabineros from the Escuela de Suboficiales de Macul.
Both were taken to said school, remaining there until the morning of September 21, at which time they were transferred to the Estadio Nacional. Around 8:00 p.m. on the 21st, the detainees were separated when Frank Teruggi was called by an Ejército officer, according to a list he was carrying. From that moment on, his friend never saw him again.
Days later, his body appeared at the Instituto Médico Legal. The death certificate stated that he had died on September 22, 1973, at 9:15 p.m., that the cause of death was "multiple gunshot wounds," and that he had died on a public thoroughfare.
The official version of his death, provided by the Ministry of Foreign Affairs, stated that Frank Teruggi had been detained on September 20, 1973, for violating the curfew and had been released due to a lack of evidence.
The Commission cannot accept this official version and, instead, has formed the conviction that Frank Teruggi was executed outside of any legal process by State agents, which constitutes a violation of human rights.
In reaching this conclusion, the Commission took into account that the victim's detention at his home—and not for a curfew violation—was verified; it was proven that he was held at the Estadio Nacional; it is established that he was killed by multiple gunshot wounds while he was deprived of his liberty and under the custody of State agents; and his execution coincides with that of Charles Horman during the same period.
