Case summary
Francisco Eugenio Viera Ovalle was a 19-year-old student leader and a militant of the Partido Socialista. He was detained in early October and executed without prior trial by Army personnel on October 11, 1973, inside the Cerro Chena detention center.

On October 11, 1973, the following individuals were killed by Ejército personnel:
Ricardo Jorge SOLAR MIRANDA, 23 years old, night watchman, community leader, and MIR militant, and
Francisco Eugenio VIERA OVALLE, 19 years old, student leader at the Universidad Técnica del Estado, who worked at the JAP in his neighborhood and was a militant in the Partido Socialista.
On September 19, Jorge Solar was detained after reporting to the Carabineros station, where he had been summoned the previous day. A few days later, he was transferred to the Cerro Chena camp. Subsequently, on October 2, Francisco Viera was detained at the home of his aunt and uncle and was likewise taken to the Cerro Chena detention center.
On October 11, both were executed inside that same prisoner facility by members of the Ejército.
The Commission reached the conviction that they were victims of human rights violations committed by state agents, which resulted in their extrajudicial execution, based on the following considerations:
– It is verified, at least with respect to one of them, that he was being held in a center controlled by the Ejército. – The victims' militancy and social work, as demonstrated by other cases from that period, made them targets for the actions that caused their deaths. – The manner of death, involving multiple gunshot wounds, was the common method of execution employed at that detention center. – As in all previous cases, there is no record of any Consejo de Guerra having been held against the victims; therefore, their execution did not correspond to a judicial decision. – Although official certificates acknowledge that the bodies were found within a military facility, there is no record of any investigation, administrative or judicial, regarding this anomaly.
