Félix Alberto Mendoza Toro died that day at 12:00 hours, at the Hospital Barros Luco, due to thoracic-abdominal trauma caused by a bullet, as stated in the Medical Death Certificate from the Legal Medical Institute.
According to the statements of eyewitnesses, on the night of June 22, Félix Mendoza and two friends were traveling in a vehicle along Avenida La Feria at the intersection with Pasaje Nueve Sur, in the José María Caro neighborhood.
Suddenly and without any warning, they were struck by a burst of machine-gun fire, carried out by a Carabineros patrol that was conducting a vehicle checkpoint established following an extremist attack on the local Sub-precinct. After the shots were fired, the police officers approached the car and ordered the occupants to get out, realizing that Mendoza Toro was wounded.
He was transported by ambulance to the Hospital Barros Luco, where he passed away hours later.
A judicial process was initiated at the Fourth Military Prosecutor's Office of Santiago to investigate the facts, in which a Carabineros officer was charged with the quasi-delict of homicide. The case was still pending when the Superior Council examined this case.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council declared Félix Alberto Mendoza Toro a victim of human rights violations by State agents who made excessive use of force.
