On September 20, 1973, Evaristo Segundo YAÑEZ ASTUDILLO, 34 years old, a leader of the Supply and Price Board (JAP) of Lampa and a militant of the Partido Socialista, was killed. On the 17th of that month, he was detained by personnel from the Peldehue Parachute and Special Forces Regiment at his parents' home located in Lampa.
He was taken to the aforementioned regiment, where he was last seen alive on the 18th. His body was later found by family members at the Legal Medical Institute. The official cause of death was a gunshot wound, occurring at 11:30 PM on the 20th.
The Commission is convinced that the death of Evaristo Yáñez constituted a case of human rights violation, as he was executed by state agents outside of any legal process. This conviction is based on the following arguments:
– The fact that his prior detention by personnel from the Peldehue Regiment has been verified; – The multiple gunshot wounds recorded on his body indicate that his death was the result of an execution similar to those carried out at that same facility in other cases reported to this Commission; – The brief period of time that elapsed between his detention and his death is insufficient for any type of trial to have been conducted against him, of which, furthermore, there is no record whatsoever.
