On October 12, 1973, Eduardo Elías CERDA ANGEL, 8 years of age, passed away.
On the day in question, the child was at his home, located in the commune of Quinta Normal, with his family. Gunshots were heard in the vicinity of the house, prompting Eduardo Elías to open the door; he was struck by a bullet in the chest, a projectile that also wounded his sister.
The victim's older brother took his body and went out into the street, following the military patrol that had fired the shots. He managed to have him taken in the very vehicle the soldiers were using to the emergency ward of the Hospital San Juan de Dios, where he arrived dead.
According to the death certificate, he passed away on October 12, 1973, at 10:30 PM due to a thoracic gunshot wound.
Taking into account the accounts of witnesses and with the death having been verified, this Commission has reached the conviction that Eduardo Angel Cerda died as a consequence of the indiscriminate use of force by agents of the State, who violated his right to life.
