On September 12, 1973, Drago Vinko GOJANOVIC ARIAS, a 23-year-old Chilean-Yugoslav national, driver for the embassy of the German Democratic Republic, and Communist Party militant, was executed.
The victim was arrested at his parents' home in Las Condes by a military patrol traveling in a jeep. From there, he was taken to his own home, which was raided, as was the home of his sister, who lived in a neighboring apartment.
He was then taken to an unknown destination; his body was later found at the intersection of Calle Tabancura and Avenida Kennedy. The body was retrieved by his family from the Instituto Médico Legal, and the cause of death, according to the respective certificate, was "thoracic gunshot wound with projectile exit and cranial-encephalic firearm explosion."
Based on the evidence presented, the Commission formed the conviction that the victim was executed outside of all legality by State agents who held him in their custody. This action constituted a violation of his human rights, specifically his rights to life and due process.
This conviction is based on the victim's status as a communist, the existence of witnesses to the arrest and the raid, and the fact that his body was found on a public street with multiple gunshot wounds.
