David Orellana Apablaza died that day at the Institute of Neurosurgery due to a cervicomedullary gunshot wound with an exit wound and bronchopneumonia secondary to the gunshot wound, as stated in the Medical Death Certificate signed by a forensic physician.

According to records contained in the judicial proceedings and evidence provided by the family, on March 20, 1974, at approximately 1:45 p.m., David Orellana was driving his taxi with two passengers on board, heading south on Avenida Los Leones.

Upon reaching the intersection with Avenida Eleodoro Yáñez, in the commune of Providencia, he turned left against a red light. A Carabineros officer who witnessed the maneuver ordered him to stop. As David Orellana did not obey, the officer boarded another taxi and began a pursuit, displaying his service weapon through the window.

Mr. Orellana stopped his vehicle, and the uniformed officer approached and fired at him, striking him in the neck. He was transported to a medical center, where he later passed away.

Following these events, proceedings were initiated at the Wartime Military Prosecutor's Office of Santiago; the Carabineros officer who fired the shot was sentenced to 100 days of military confinement in the minimum degree as the perpetrator of a quasi-delict of homicide against the person of David Orellana.

Considering the evidence gathered in the investigation conducted by this Corporation, the Superior Council declared David Orellana Apablaza a victim of human rights violations committed by a State agent who made irrational use of force.
