Case summary

On September 20, 1973, Darío Hugo MONTOYA TORRES, 19 years old, a conscript in the Buin Regiment with no political affiliation, was executed in Cobquecura, outside of all legality.
On the morning of the indicated day, Carabineros from Cobquecura arrived at the home of the victim's grandmother, where he was visiting while on medical leave. They forced him and a friend who was also in the house to get up.
They made them leave amidst accusations of having destroyed a public telephone, and despite their claims of innocence, they were shot. Darío Montoya was killed instantly, and his companion was wounded; the latter, after feigning death, was able to flee the scene.
Hours later, the carabineros returned and ordered the young Montoya's relatives to bury him immediately, which they did. Days later, authorization was obtained to exhume him and bury him legally. The death certificate issued at that time states the cause of death as: "internal hemorrhage as a consequence of three gunshots to the shoulders and liver, at least two of which passed through, with exit wounds in the back.
Execution by firing squad."
In the preceding case, the Commission formed the conviction that a grave violation of the victim's human rights occurred. The responsibility lay with State agents who, outside of all legality, killed him for his alleged authorship of a very minor offense, which, moreover, he had not committed. The lack of explanations from the police authority regarding these events contributes to this conviction.
