Danilo Wilfredo Quezada Capetillo, a militant of the Movimiento de Izquierda Revolucionaria (MIR), died that day at 11:30 hours in Viña del Mar due to complicated cranial and thoracic-abdominal gunshot wounds, as recorded in his Medical Death Certificate.
The Autopsy Protocol records that he received three frontal gunshot impacts and another seven impacts from behind; the addendum to this report specified that the gunshot wounds located in the right parietal region, the left posterior cervical region, and the right internal retro-Achilles region were fired at close range, that is, "approximately between 60 centimeters and 1 meter" away.
Danilo Quezada had entered the country clandestinely after having remained abroad due to the fulfillment of a sentence of banishment to which he had been condemned for violating the State Security Law. Previously, he had been held at the Tres Alamos prisoner camp and the Antofagasta Jail.
According to the official version provided to the Military Prosecutor's Office, the Policía de Investigaciones surprised Danilo Quezada and another MIR militant in the Santa Inés sector of Reñaca Alto while they were handling a vehicle containing an explosive charge.
At the moment they were surprised, they attempted to defend themselves by firing firearms at the police officers and then fled toward a ravine area in the location. Danilo Quezada was killed in the confrontation, and his companion and a police officer were wounded.
Members of the Central Nacional de Informaciones (CNI) and Carabineros arrived at the scene. Officials from the Policía de Investigaciones and the CNI declared that Danilo Quezada was hiding in a ravine and that tear gas canisters were launched into that location to force him out of his hiding place.
The MIR militant who survived these events contradicted the version that an armed confrontation had taken place with members of the Policía de Investigaciones. He acknowledges that he had met with Danilo Quezada to prepare the explosives found in the vehicle, but asserts that he was unarmed and that shots were fired at them immediately upon being surprised as they attempted to flee toward the ravine sector.
He stated that he did not see Danilo Quezada brandish a firearm at those moments.
Considering the evidence gathered by the Corporation, the Superior Council reached the conviction that he was executed by State agents outside of any legal process while he was being held in a subdued state. For this reason, it declared him a victim of human rights violations.
