Daniel Enrique Peña Brunes, a member of the Partido Comunista, died that day at 5:00 hours in the Antofagasta Public Prison, asphyxiated by hanging, as certified by his death certificate.
According to a statement by his spouse, on June 18, 1974, Daniel Peña was in bed at his home, suffering from pneumonia. Around 2:00 hours, he was arrested by Carabineros officers, who transported him to the Grupo de Instrucción facility.
At this location, according to eyewitnesses, he was subjected to beatings, abuse, and interrogations under torture for three days, after which he was sent to the Antofagasta Public Prison, where he remained held incommunicado in dire physical condition.
A witness who saw him at this facility stated that his skin was bruised, he had burns on different parts of his body, and his fingers were fractured.
Seven days later, the Gendarmería notified the family that Daniel Peña had committed suicide in his cell by hanging himself from a beam with a wire. The body was delivered to his relatives in a sealed coffin, without the required identification process being performed.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council reached the conviction that Daniel Enrique Peña Brunes made the decision to take his own life due to the torture and mistreatment to which he was subjected by State agents, driven by the legitimate fear that he would again be subjected to the degradations he had been forced to endure while deprived of his liberty.
