Dámaso Ulises Montecinos Diaz died that day at 21:25 hours, at the Hogar de Cristo facilities, due to acute renal failure, paraplegia secondary to spinal cord transection, multiple pressure ulcers, and cachexia, as stated in the Medical Death Certificate signed by the attending physician.

According to witness statements, on October 15, 1983, at approximately 1:00 hour, Dámaso Montecinos was walking with his partner and daughter near the corner of Calle Neptuno and Ingeniero Giroz, in the current commune of Lo Prado, where political protest actions were taking place. Under these circumstances, he was wounded by a gunshot fired by a civilian who had stepped out of a car.

The projectile passed through one of his arms and ended its trajectory in his spinal column, causing injuries to his lungs. He was taken to the Hospital San Juan de Dios, where he underwent several surgical interventions. On November 29, 1983, he was admitted, as a terminal patient, to the Padre Hurtado ward of the Hogar de Cristo, where he passed away four months later.

Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council reached the conviction that the attack suffered by Dámaso Ulises Montecinos Díaz was politically motivated and that his death was a consequence of the serious injuries caused by that attack. For this reason, it declared him a victim of the prevailing political violence.
