Case summary

On October 23, 1973, the following individuals were executed at the Tocopilla Police Station:
-Carlos Oscar GALLEGOS SANTIS, 30 years old, teacher, Socialist Party militant; he had been detained on September 17 near his home and transferred to the Tocopilla Police Station. He remained there without the right to receive visitors until the date of his death.
-Breno Benicio CUEVAS DIAZ, 45 years old, health inspector, Socialist Party militant; detained on September 16, 1973, at his home by carabineros. Taken to the Tocopilla Police Station, he remained held there and also in the Public Jail. He was not permitted to receive visitors during the period of his detention.
-Julio Enrique BREWE TORRES, 26 years old, teacher, union leader, Socialist Party militant; detained when he voluntarily presented himself at the Tocopilla Police Station on September 18, remaining held in that facility without the right to visits until the day of his death.
-Vicente Ramón CEPEDA SOTO, 31 years old, surgeon, Director of the CODELCO Polyclinic, Socialist Party militant; detained on September 20 by Carabineros, who took him to the Police Station where he remained until his death, without the right to be visited. From that facility, he was taken to other locations to be subjected to interrogations and then returned to the Police Station.
On October 23, an official statement was issued by the Chief of the State of Siege Zone, which indicated that the deaths had occurred as follows: "Under circumstances in which the jailer of the Tocopilla Police Station proceeded to open the door of one of the cells to take prisoner Vicente Cepeda Soto to the bathroom, as he had requested authorization to do so, Cepeda, in the company of prisoners Breno Cuevas Diaz, Julio Brewe Torres, and Carlos Gallegos Santis, with whom he shared said cell, suddenly and surprisingly attacked the officer, managing to snatch his SIG rifle from him, without managing to use it due to a lack of knowledge of how to operate it and the weapon being on safety." Upon the jailer's calls for help, on-duty personnel arrived, "who immediately opened fire on the aggressors, who were killed at the scene of the events," all in accordance with "Proclamation No. 8 of September 19 last and Article 281 of the Code of Military Justice."
The aforementioned statement was published in the newspaper El Mercurio de Antofagasta on October 25, 1973, under the headline "4 extremists killed in Tocopilla."
The death certificates of the four victims indicate the cause of death as gunshot wounds, and the place and time as: Tocopilla Police Station at 03:55 hours.
The Commission formed the conviction that the deaths of the four identified detainees constituted executions outside of all legality, for which State agents are responsible, in violation of their human rights, based on the following circumstances:
-The implausibility that the victims would have attempted to escape from their place of detention in the manner described by the official version, which would have meant facing the entire garrison with a single weapon that, furthermore, they did not know how to use, and while in precarious physical condition after a month of detention and subjection to repeated interrogations; -The fact that even in the event that an attempt of that nature had occurred, it does not appear necessary to suppress it as was reported to have been done, that is, by killing four detainees who did not know how to use the weapon they had allegedly obtained and who even allowed the guard to call for his colleagues.
