On September 24, 1973, Carlos Enrique Mario NICHOLLS RIVERA, 27 years old, a chemical engineer and member of the Communist Party, was executed after being detained at his home in the Maipú commune by a military patrol.
On the day of his detention, he was taken to the FISA facility, from where he was removed during the night to be subsequently executed on a public road at the intersection of Avda. General Velásquez and Camino a Melipilla.
His body was interred in Patio 29 of the General Cemetery by administrative authorities without informing his family, who were able to exhume him some time later. The corresponding autopsy report indicates that the cause of death was multiple complicated thoraco-abdominal gunshot wounds, with the date of death being the same day as his detention.
The Commission has reached the conviction that the death of Carlos Nicholls Rivera was the result of his execution outside of any legal process, constituting a grave violation of human rights attributable to the actions of state agents.
This conviction is based on the fact that the detention of the victim, his violent death, and the circumstances of his burial are documented, while also taking into account the victim's political affiliation.
