Case summary

Carlos Alberto Urrutia Díaz died that day at 19:00 hours, at the Instituto de Neurocirugía in Santiago, due to craniocerebral trauma caused by a bullet, as certified by the Medical Death Certificate from the Instituto Médico Legal.
According to statements from family members and witnesses, on October 13, around 23:00 hours, Carlos Urrutia was returning to his home in the La Pincoya neighborhood of Conchalí. As he passed in front of a house, two dogs began to bark at him and he threw some stones at them.
The house was inhabited by a Carabineros officer, who came out with a weapon in his hand and, through the gate, fired a shot, wounding Carlos Urrutia in the head. He then entered his home without providing any assistance.
The wounded man was taken by a neighbor to a medical center, where he passed away.
The official version from Carabineros stated that the officer was forced to repel an attack on his home by a mob with his service weapon, as a result of which Carlos Urrutia was wounded. Furthermore, the police institution, through a report sent to the Second Military Court, denounced the alleged crime of assault against the uniformed officer and attempted trespassing.
This process concluded in 1991 with a dismissal, as it was deemed that the crime of unnecessary violence, which was also investigated by the Military Tribunal, had not been proven, despite the fact that the conclusions reached by the Policía de Investigaciones, and which were recorded in the Order to Investigate, totally refuted the officer's version.
Regarding the crime of physical abuse against a *carabinero*, the Prosecutor's Office determined not to initiate summary proceedings due to the death of the accused.
In the parallel process followed in the 21st Criminal Court of Santiago, it was reliably established, through witness statements, expert reports, and the expansion of the Autopsy Report, that the shot was fired at close range and that the perpetrator was not attacked by a mob as he declared in the Tribunal, a version that had also been recorded in the institution's official account.
In this process, a sentence was handed down in October 1988, sentencing the officer to seven years in prison as the perpetrator of the crime of homicide. However, said sentence had not been served by the date on which the Council of this Corporation reviewed the case, as the Supreme Court, while hearing an appeal for cassation, ordered the suspension of the execution of the sentence.
Considering the background information gathered and the investigation carried out by this Corporation, the Superior Council reached the conviction that the death of Carlos Alberto Urrutia Díaz was due to an abuse of power committed by an agent of the State, who acted outside the scope of his duties and for whom institutional impunity was sought.
By virtue of this, it declared him a victim of human rights violations.
