On July 2 and July 3, 1986, on the occasion of the National Strike, eight people died:
Iván Marcelino AQUEVEQUE ANTILEO, 21 years old, worked as a carpenter's assistant.
In the early hours of July 2, he was on a public street when he was struck by a bullet that passed through his thorax, causing his death. Various testimonies coincide that the victim was on the street with other young people when a military patrol appeared. The young people fled and the soldiers fired their firearms. One of the bullets struck him.
This Commission, taking into account the information received regarding the case and other testimonies about the conduct of military personnel in public order control operations during days of political demonstrations, is convinced that Iván Aqueveque was killed by State agents who, by making excessive use of force, violated his human rights.
Rodrigo Andrés ROJAS DENEGRI, 19 years old, was a photographer. He resided habitually in the United States and had been in Chile for six weeks prior to the events that ended in his death.
In the early hours of July 2, 1986, the first day of the National Strike, he went with other young people to participate in the building of a barricade-bonfire. He was detained, along with a young woman who was part of the group, by members of a military patrol, one of whom brought incendiary materials to the site that the young people had left abandoned further back.
Subsequently, in a confusing incident that has been legally disputed, the two detainees were set on fire. The soldiers extinguished the flames by wrapping the two young people in blankets. They then placed them in a military vehicle and abandoned them far from the place of detention.
Later, they were assisted by private citizens and picked up by Carabineros officers, who had them transported in a private car to a medical center where they received medical attention. Only the young woman managed to survive. Rodrigo Rojas passed away on July 6 at the Posta Central.
Having known and analyzed all the information of the case and the different versions presented before the competent Tribunal, this Commission is convinced that Rodrigo Rojas was a victim of a serious human rights violation, insofar as his death, whatever the degree and nature of the individual responsibility of those involved, occurred as a direct consequence of the illicit actions or omissions of the military personnel.
Nadia del Carmen FUENTES CONCHA, 13 years old, a primary school student, was walking along Avenida El Parque (Santiago) on the morning of July 2 when she was struck by a gunshot that caused her death.
Testimonies received by the Commission indicate that the shots were fired indiscriminately by a military patrol located in the vicinity of the site. Versions regarding disturbances or acts of violence at the time and place of the events could not be verified.
The information presented leads this Commission to the conviction that military personnel, in an excessive use of force, caused the death of the minor Nadia del Carmen Fuentes, violating her human rights.
Francisco Humberto LOPEZ ZUÑIGA, 19 years old, was on the street in the Oscar Bonilla neighborhood (Santiago) on the afternoon of July 3 when he was struck by a bullet, dying shortly thereafter in the hospital.
Testimonies known to the Commission indicate that the shots were fired by personnel moving in a military truck. The circumstances regarding whether or not there were incidents or disturbances are confusing, as there are contradictory, unverified versions.
These testimonies and the general consideration regarding the procedure employed by the military during this National Strike lead this Commission to the conviction that Francisco López was a victim of a human rights violation for which State agents, who made excessive use of force, are responsible.
Ernesto Igor RIOS CESPEDES, 18 years old, a Technical Drawing student at the Universidad Católica, was on a public street in the La Legua neighborhood (Santiago) on the morning of July 3 when he was struck by a bullet that passed through his head.
He died due to "craniocerebral trauma from a bullet, with projectile exit." Witnesses indicated that the shots were fired at a group of people by military personnel.
It is not possible to determine with precision the other circumstances of the event, but the manner of death by bullet, the statements of witnesses, and the general context of military patrolling allow for the conviction that Ernesto Igor Ríos was a victim of a violation of his right to life committed by State agents who made excessive use of force.
Boris Aroldo VERA TAPIA, 26 years old, an accountant by profession, was participating in street demonstrations on the night of July 2 at the corner of Avenida La Feria and Ramona Parra (Santiago).
Multiple and consistent testimonies indicate that unidentified civilians moving in a utility vehicle fired shots at the demonstrators. One of those bullets killed Boris Aroldo Vera.
Attending to the facts and the context, this Commission is convinced that he was a victim of a human rights violation committed by private individuals under a political pretext.
Rubén Alejandro CONTRERAS GRANDON, 18 years old, was at Avenida Américo Vespucio and Rojas Magallanes (Santiago) on the afternoon of July 3 when he was struck by a bullet in the back. He died due to a "thoraco-abdominal bullet wound."
The versions received by the Commission coincide that an intense shootout occurred at the scene, where State agents acted, but they do not allow for the origin of the fatal shot to be specified. However, the facts and their context allow this Commission to form the conviction that Rubén Alejandro Contreras fell as a victim of the political violence of the period.
José Eduardo VALDIVIA VALENZUELA, 17 years old, single, a laborer and 4th-year high school student at a night school, was participating in a barricade-bonfire on the corner of Lucero and La Estrella streets (Santiago) on July 3 when he was struck by a bullet that caused his death.
The versions known to the Commission establish that shots were fired directly at demonstrators, but it is not possible to clarify the origin of the shots. Therefore, this Commission is convinced that José Eduardo Valdivia was a victim of a human rights violation committed by private individuals who acted under political pretexts, presumably opposed to the day of protest.
