On September 13, 1973, Bernardo Segundo JIMENEZ LUCERO, 33, a newspaper vendor and member of the Partido Comunista, was killed. The victim disappeared from his home in San Francisco de Mostazal between September 11 and September 12, 1973.
Neighbors informed the family that he had allegedly been killed. Two months later, they learned that his remains were supposedly half-buried in front of the Puente Negro de Romeral. At that location, they found a body that is strongly presumed to be that of the victim.
Carabineros, in the official report documenting the discovery of the body, stated that the victim had died as a result of a military operation carried out in San Francisco de Mostazal on September 13, 1973. The date of death, according to the respective death certificate, is that same day.
The autopsy performed concluded that death was caused by a skull fracture and other wounds attributable to the actions of third parties, and noted that the body appeared wrapped in nylon.
The Commission concluded that Bernardo Jiménez was executed by State agents in an act of violation of his human rights. This conviction is supported by: the fact that the victim was a member of the Partido Comunista, as were other individuals who suffered violations of their fundamental rights during those days; the official acknowledgment by Carabineros that his death occurred at the hands of State agents; and the circumstance that his body was not returned to his family.
