HAVING SEEN: It has been ordered to conduct a summary investigation in criminal case File No. 16.996-AyB, to which were joined files No. 16.209 of the Second Criminal Court of Coyhaique, File No. 2.182-98, and File No. 16.996-B of the First Criminal Court of Coyhaique, for the purpose of investigating the existence of the crime of Permanent Kidnapping of Juan Vera Oyarzún, José Rosendo Pérez Ríos, and Néstor Hernán Castillo Sepúlveda , and the responsibility that may correspond to the defendants José María Fuentealba Suazo , national identity card No. 4.320.203-0, Chilean, born on September 13, 1938, in Tomé, 67 years old, married, physician, no prior criminal record, residing at Calle Baquedano No. 1326 in Iquique; Raúl Bahamonde , national identity card No. 3.262.303-4, Chilean, born on April 2, 1933, in Coyhaique, 73 years old, married, no prior criminal record, residing at Calle Manuel Rodríguez No. 132 in Coyhaique; Miguel Ángel Rondon , national identity card No. 3.991.585-3, Chilean, born on September 29, 1937, in Linares, 69 years old, married, retired from the Army, no prior criminal record, residing at Población Yerbas Buenas, Calle Pehuén No. 1269, Linares; and Gustavo Rivera Toro , national identity card No. 3.059.153-4, Chilean, born on January 20, 1933, in the city of Chillán, 73 years old, married, pensioner of the National Defense, no prior criminal record, residing at Parcela 14, El Naranjal, Talagante. The investigation was initiated with official letter No. 200, dated February 6, 2001, from the Illustrious Court of Appeals of Coyhaique, referring to official letter No. 003335 dated January 26, 2001, from the Supreme Court, in administrative records AD-16.899 related to the disappearance of Néstor Castillo Sepúlveda, José Rosendo Pérez Ríos, and Juan Vera Oyarzún II.- That the defendant

, already identified, is sentenced as AUTHOR of the repeated crimes of aggravated kidnapping, perpetrated starting from October 27, 1973, against the persons of Juan Vera Oyarzún, José Rosendo Pérez Ríos, and Néstor Hernán Castillo Sepúlveda , to the single penalty of SEVEN YEARS OF MAJOR IMPRISONMENT IN ITS MINIMUM DEGREE; to the accessory penalty of absolute perpetual disqualification from public offices and positions and political rights, and absolute disqualification from professional titles for the duration of the sentence, and to the payment of court costs.

, already identified, is sentenced as AUTHOR of the repeated crimes of aggravated kidnapping, perpetrated starting from October 27, 1973, against the persons of Juan Vera Oyarzún, José Rosendo Pérez Ríos, and Néstor Hernán Castillo Sepúlveda , to the single penalty of THREE YEARS AND ONE DAY OF MINOR IMPRISONMENT IN ITS MAXIMUM DEGREE; to the accessory penalty of absolute perpetual disqualification from public offices and positions and political rights, and absolute disqualification from professional titles for the duration of the sentence, and to the payment of court costs.

, already identified, is sentenced as ACCOMPLICE to the repeated crimes of aggravated kidnapping, perpetrated starting from October 27, 1973, against the persons of Juan Vera Oyarzún, José Rosendo Pérez Ríos, and Néstor Hernán Castillo Sepúlveda , to the single penalty of THREE YEARS AND ONE DAY OF MINOR IMPRISONMENT IN ITS MAXIMUM DEGREE; to the accessory penalty of absolute perpetual disqualification from political rights and absolute disqualification from public offices and positions for the duration of the sentence, and to the payment of court costs.

GUSTAVO RIVERA TORO

, already identified, is sentenced as ACCESSORY AFTER THE FACT to the repeated crimes of aggravated kidnapping, perpetrated starting from October 27, 1973, against the persons of Juan Vera Oyarzún, José Rosendo Pérez Ríos, and Néstor Hernán Castillo Sepúlveda , to the single penalty of SIX HUNDRED DAYS OF MINOR IMPRISONMENT IN ITS MEDIUM DEGREE; to the accessory penalty of absolute perpetual disqualification from political rights and absolute disqualification from public offices and positions for the duration of the sentence, and to the payment of court costs.
