Case summary

Carlos Patricio Dall Orso Badilla died that day at 19:10 hours, at the Hospital Gustavo Fricke in Viña del Mar, due to cardiac arrest and septicemia, as certified by the Medical Death Certificate signed by the attending physician.
According to witness statements, Carlos Dall Orso, a militant of the Socialist Party and later the Movimiento de Izquierda Revolucionario (MIR), was first detained on September 13, 1973, at his workplace by Ejército personnel belonging to the Quillota Regiment.
As he himself recounted to his family, he was tortured and beaten on his back and abdomen. Due to the blows he received to his face with rifle butts, he suffered a fractured jaw and loss of vision in one eye.
In 1977—by then linked to the MIR—he was detained by agents of the Dirección de Inteligencia Nacional (DINA), who subjected him to repeated mistreatment and torture: the application of electricity, hanging by his wrists, and beatings with sandbags.
He remained held for more than a week in the basement of the Investigaciones barracks in Valparaíso and was subsequently transferred to the Valparaíso Prison; upon entering this facility, he could barely walk and was spitting and urinating blood.
He was placed at the disposal of the Naval Prosecutor's Office of that port, accused of violating the State Security Law, and was imprisoned for seven months. When he was released, his physical condition was grave.
According to medical reports, he suffered from chronic renal failure, which reached a terminal state in 1986, a time when Carlos Dall Orso had to undergo dialysis two or three times a week while waiting to undergo a kidney transplant.
He was detained again in April 1986 and taken to the Quillota Prison, but due to his state of health, he had to be transferred to the Hospital Gustavo Fricke in Viña del Mar. On May 30, he underwent surgery for a gastric ulcer, during which cancer was detected. He was granted his freedom days before his death.
Considering the background information gathered by this Corporation, the Superior Council reached the conviction that the illness that caused his death was decisively influenced by the repeated torture to which he was subjected during his detentions and the lack of timely medical assistance. For this reason, it declared Carlos Patricio Dall Orso Badilla a victim of human rights violations.
