On January 3, 1985, Alan William RODRIGUEZ PACHECO, 28 years old and a militant of the MIR, died.
According to the official version, the events took place around 11:15 a.m. on January 3, 1985, when security personnel entering the property at Calle Victoria N° 2304 in the commune of Maipú received gunfire from inside.
They returned fire, resulting in an exchange of shots lasting approximately half an hour, which caused the house to catch fire. Alan Rodríguez, who was also defending himself with a mortar, died burned.
However, witnesses indicate that on the day of the events, a large contingent of security forces arrived at the scene, supported by a jeep carrying a machine gun. The house, made of light materials, was surrounded by CNI agents who ordered Alan Rodríguez to surrender, immediately beginning to fire at him without any opposition on his part.
The official claim that the victim was carrying a mortar is not credible, as a weapon of that type would have caused significant damage and injuries among the agents, which did not occur. Likewise, the fact that the weapon was later displayed intact does not align with the complete burning of the property.
For all the above reasons, the Commission considers that Alan Rodríguez was executed by CNI agents who were not seeking his arrest but his elimination, considering his death a human rights violation for which state agents are responsible.
