Adolfo Avila Ramírez died that day at 16:00 hours, at the Barros Luco Hospital, due to a gunshot wound, as recorded in the Medical Death Certificate from the Legal Medical Institute.

On September 12, 1973, a curfew was in effect throughout the entire day. According to eyewitness accounts, around 13:00 hours, and because gunfire could be heard in the area, Adolfo Avila went out to look for his mother-in-law who was outside his home in the Joao Goulart neighborhood.

As he was leaving the residence, he was shot by a Carabineros officer who was stationed at the entrance of the alleyway and who knelt to aim at him.

Help was requested from the same uniformed officers who remained at the scene to transport him to a medical center. However, they were ordered to return to their home under threat of death. Finally, he was transported to the Barros Luco Hospital in an ambulance that passed through the area, where his death was confirmed.

Considering the evidence gathered and the investigation carried out by this Corporation, the Superior Council declared Adolfo Rigoberto Avila Ramírez a victim of human rights violations by State agents who made irrational use of force.
